2.1 The Company provides waste collection and rubbish removal services within its operational service area. The exact nature of the Services and the type and volume of Waste to be removed will be as agreed between the Customer and the Company at the time of booking.
2.2 The Company reserves the right to refuse to remove any items that it reasonably considers unsafe to handle, prohibited by law, incorrectly described, or beyond the agreed scope or capacity stated in the Quotation.
2.3 The Company is not obliged to provide any service not specifically agreed in advance. Any additional work requested on site may be subject to extra charges, which must be agreed with the Customer before such work is undertaken.
3.1 Bookings may be made by telephone, email, or through any booking system operated by the Company. All bookings are subject to availability and acceptance by the Company.
3.2 When making a booking, the Customer must provide accurate information, including the collection address, access details, approximate volume or description of Waste, and any relevant access restrictions such as parking limitations or time limits.
3.3 The Company may provide a Quotation based on information supplied by the Customer before attendance, or may confirm or adjust the Quotation upon arrival after inspection of the Waste.
3.4 A Contract is formed when the Customer accepts the Quotation and the Company confirms the booking, or when the Company arrives at the site and the Customer permits the work to commence.
4.1 All prices quoted are based on the information provided by the Customer, including the estimated volume, type, and weight of Waste, and the ease of access to the property or collection point.
4.2 The Company reserves the right to revise the Quotation if the actual nature, volume, or difficulty of the job differs significantly from the information originally provided, including where the Waste is heavier, bulkier, or more difficult to access than described.
4.3 Any revised pricing will be explained to the Customer on site before work continues. If the Customer does not agree to the revised charges, the Company may cancel the Service, and a reasonable call-out or attendance fee may apply to cover time and travel costs.
4.4 Unless clearly stated otherwise, all prices are quoted in pounds sterling and are exclusive of any applicable taxes or charges that may be imposed by law.
5.1 Payment is due in full on completion of the Services, unless agreed otherwise in writing in advance.
5.2 The Company accepts payment by the methods communicated to the Customer at the time of booking or on completion. The Customer is responsible for ensuring that sufficient funds are available and that payment details are valid.
5.3 For commercial Customers, subject to a separate agreement, the Company may extend credit terms. Where credit is offered, invoices are payable within the period specified on the invoice. In the absence of a stated period, payment must be made within 14 days of the invoice date.
5.4 If payment is not received by the due date, the Company reserves the right to charge interest on overdue sums at the maximum rate permitted by law and to recover any reasonable costs incurred in the collection of late payments, including administrative charges and legal costs.
6.1 The Customer may cancel or amend a booking by providing notice to the Company. Where possible, the Customer should give at least 24 hours notice prior to the agreed collection time.
6.2 If the Customer cancels with less than 24 hours notice, the Company reserves the right to charge a cancellation fee to cover time and resources allocated to the booking.
6.3 If the Company arrives at the collection address at the agreed time and is unable to gain access, or the Customer fails to be present where their presence is required, the Company may treat the visit as a cancellation and a call-out or wasted journey fee may be charged.
6.4 The Company reserves the right to cancel or reschedule any booking at any time, for example due to unsafe conditions, vehicle breakdown, adverse weather, staff illness, or other circumstances beyond its control. In such cases, the Company will seek to inform the Customer as soon as reasonably practical and will offer an alternative appointment where possible.
7.1 The Customer must ensure that the Company and its operatives have safe and reasonable access to the Waste to be collected. This includes providing clear access routes, suitable parking where required, and, where applicable, arranging any necessary permissions for parking or entry.
7.2 The Customer must ensure that Waste presented for collection is accurately described, is not hazardous or dangerous unless previously declared and agreed, and is placed in a location that is safe for operatives to access and handle.
7.3 The Customer is responsible for informing the Company of any relevant risks at the property, including but not limited to structural issues, the presence of asbestos, sharp or hazardous objects, or any other health and safety concerns.
7.4 The Customer must not knowingly present for collection any items that are prohibited by law, including certain types of chemical, clinical, biological, or hazardous waste, unless the Company has explicitly agreed to handle such waste in compliance with applicable regulations.
8.1 The Company operates in accordance with applicable UK waste management legislation and regulations, including duties relating to the storage, transport, and disposal of waste.
8.2 The Company will transport collected Waste only to authorised and licensed facilities and will take reasonable steps to ensure that Waste is handled responsibly, with appropriate reuse, recycling, or disposal methods applied where feasible.
8.3 The Customer acknowledges their legal duty of care in relation to Waste and agrees to co-operate with the Company to facilitate lawful and responsible disposal. This may include providing information about the origin and composition of the Waste where reasonably required.
8.4 Where required by law, the Company may issue a waste transfer note or other documentation relating to the collection and disposal of Waste. The Customer must retain any such documentation in accordance with legal requirements.
9.1 Certain items cannot be collected as part of standard rubbish removal services, including but not limited to explosives, firearms, medical waste, toxic substances, and any waste classed as hazardous unless separately agreed.
9.2 If hazardous or prohibited Waste is discovered during the course of providing the Services, the Company may suspend or terminate the job immediately. The Customer may be charged for any work already carried out, and may also be liable for any additional costs reasonably incurred by the Company in dealing with such items.
9.3 The Customer is responsible for ensuring that any special waste, such as electrical equipment, batteries, tyres, or appliances containing gases, is disclosed at the time of booking so that appropriate handling and pricing can be arranged.
10.1 The Company will exercise reasonable care and skill in providing the Services. However, the Company shall not be liable for any loss or damage arising from inaccurate information provided by the Customer or from circumstances beyond the Company’s reasonable control.
10.2 The Customer is responsible for identifying any items which must not be removed. The Company will not be liable for the removal of any items mistakenly presented as Waste or not clearly separated from Waste unless such removal was the result of gross negligence by the Company.
10.3 The Company’s liability for any direct loss or damage to property resulting from its negligence shall, in any event, be limited to the cost of repair or replacement of the damaged item, up to a maximum aggregate amount equal to the total charges paid or payable by the Customer for the relevant Services.
10.4 The Company shall not be liable for any indirect or consequential loss, including loss of profit, loss of business, loss of opportunity, or any similar claims, whether arising in contract, tort, or otherwise, even if such loss was reasonably foreseeable.
10.5 Nothing in these Terms and Conditions shall exclude or limit liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited under UK law.
11.1 The Company maintains insurance cover appropriate to the nature of its Services, including public liability insurance to a reasonable level.
11.2 The existence of insurance does not extend or increase the Company’s liability beyond the limits set out in these Terms and Conditions. The Customer remains responsible for taking out any additional insurance they consider necessary in respect of their property and possessions.
12.1 If the Customer has any concerns or complaints regarding the Services provided, they should notify the Company as soon as possible, providing full details of the issue.
12.2 The Company will investigate any complaint in a fair and timely manner and will seek to resolve matters directly with the Customer. The Customer agrees to give the Company a reasonable opportunity to remedy any service issues.
12.3 If a dispute arises that cannot be resolved informally, the parties agree to consider negotiation or mediation before commencing any legal proceedings, where this is practical and appropriate.
13.1 The Company may collect and process personal data about Customers for the purposes of managing bookings, providing Services, processing payments, and maintaining records.
13.2 The Company will handle personal data in accordance with applicable UK data protection legislation and will take reasonable steps to keep such data secure and confidential.
13.3 The Customer is responsible for ensuring that any personal data they provide is accurate and up to date and for informing the Company of any changes relevant to the provision of Services.
14.1 The Company shall not be liable for any delay or failure in performing its obligations where such delay or failure results from events or circumstances beyond its reasonable control. Such events may include, but are not limited to, severe weather, traffic disruptions, accidents, strikes, acts of government, or failures of utilities or transport networks.
14.2 In such cases, the Company will endeavour to resume or reschedule the Services as soon as reasonably practicable and will keep the Customer informed where possible.
15.1 The Company reserves the right to update or amend these Terms and Conditions from time to time. Any such changes will take effect when published or when otherwise communicated to the Customer.
15.2 The Terms and Conditions in force at the time of booking will apply to that booking, unless a change is required by law or regulation, in which case the updated terms may apply immediately.
16.1 If any provision of these Terms and Conditions is found by a court or competent authority to be invalid, illegal, or unenforceable, that provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable, or, if that is not possible, deleted.
16.2 Any such modification or deletion shall not affect the validity and enforceability of the remaining provisions, which shall continue in full force and effect.
17.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter or formation, shall be governed by and construed in accordance with the laws of England and Wales.
17.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the provision of Services by the Company.
